Immigration policies and practices have long raised important constitutional questions and concerns.Ā For instance, the Constitution sets boundaries on who can enforce immigration law and how, and provides important protections to noncitizens, including the rights to due process and habeas corpus, equal protection, and Fourth Amendment safeguards against illegal searches and seizures. Ā Over the years, The Constitution Project has released a variety of reports and recommendations, and conducted policy advocacy to protect constitutional safeguards for immigrants and throughout immigration proceedings. The recent Supreme Court decision in Arizona v. United States, a closely watched case in which the federal government successfully challenged some, but not all provisions of Arizonaās controversial immigration law (SB 1070), is a significant development, but far from the end of the national immigration debate.Ā Immigration policies and practices at the federal, state, and local levels ā and the ongoing tugs of war between and among those entities over who can enforce immigration law and how ā continue to raise important constitutional questions and concerns.Ā In his opinion in Arizona, Justice Kennedy urged that our quest for answers to those questions take the form of a āsearching, thoughtful, rational civic discourse.”Ā TCPās Immigration Committee, including policy experts, legal practitioners and former government officials with broad experience and widely divergent views, are eager to make a meaningful contribution to such a discourse.
