Former Judges and Prosecutors Encourage Judge to Reconsider Special Prosecutor’s Appointment

In a letter organized by The Constitution Project’s Clearinghouse of New Voices, fifty-nine former judges, prosecutors and other legal professionals urged Prince William County Judge Mary Grace O’Brien to consider replacing the special prosecutor in the capital prosecution of Justin Wolfe. A federal court overturned Wolfe’s original conviction and death sentence due, in part, to prosecutorial misconduct. As reported by the Associated Press, the letter expressed concern that the recently named special prosecutor too quickly decided to retry Wolfe, suggesting that the special prosecutor “did not carefully examine the evidence to reach an independent conclusion about the case, but instead relied on the earlier deliberation” of the prosecutors whose misconduct and errors in judgment left Mr. Wolfe on death row for more than a decade.
